    By commissioning me, you confirm that you've read and agreed to these terms.

    Before I start any Project, I need to make sure all parties are on the same page to avoid any confusion over the details and use of the commissioned work. Please take the time to read the following terms carefully. If you have any questions or issues regarding these terms, you may fill this form.
    I will not answer any questions regarding these terms through any other means.

    I. GENERAL TERMS

    • a. All commissioned Projects are meant for Personal Use only by the Client unless Commercial Rights are negociated (Additional fees apply, defined upon agreement).

    • b. The commissioned Project(s) may be used for Personal Use. Such as in profile pictures, banners, posted on personal social media or websites, used in slides and in educational material provided credit is clear and accessible to others. The Project may also be printed strictly for personal use.

    • c. When placing an order, the Client must provide clear, detailed and complete requirements and expectations upfront, such as descriptions, reference materials, assets and expected deadlines (if any). Additional information may be requested during the Project process.

    • d. I reserve the right to refuse a Project request based on content, subject, compliance or other reasons.

    • e. The Client guarantees that the produced Project(s) will not be turned/used/edited into Non-Fungible Tokens (NFT), resold through Cryptocurrency, uploaded into Large Language Models (LLM) or any Machine Learning Models (AI) or be featured in any Blockchain technology media.

    • f. I will never turn/use/edit Projects into Non-Fungible Tokens (NFT), resell them through Cryptocurrency, upload them into Large Language Models (LLM) or any Machine Learning Models (AI) or feature them in any Blockchain technology media.

    • g. By placing an order with 18+ themes, you are confirming you are over 18.

    II. PAYMENT AND FEES

    • a. All payments are made in full and upfront before starting any Project.

    • b. I only accept the following payment methods:

    1. PayPal in Euro.

    2. MBWAY (National payments ONLY).

    3. Bank Transaction (National payments ONLY).

    • c. The Client will be notified when the invoice is sent through Paypal or MBWAY.

    • d. The Client must wait for an invoice or payment request and must not make any payments on their own.

    • e. Paypal invoices must be paid within 7 days, otherwise the Project request will be declined.

    • f. With payments through MBWAY and Bank Transaction, the process of the commissioned Project will only begin when the balance as reached me, not when the transaction is made.

    • g. After the Project is delived, if the Client wishes to renegociate its copyright usage, we may discuss the added on fees.

    • h. If the Client wants any major changes made to the final product, extra fees will apply.

    • i. Under no circumstances do I accept payments in Cryptocurrency or other payment methods not stated in these terms.

    III. PROCESS

    • a. My Project requests order is based on a first-come/first-served manner and rush order fees upon payment. The list and status of your request can be consulted here.

    • b. If the Client has a short deadline for a Project, extra charges will apply.

    • c. I provide Work in Progress (WIP) proof to all Clients when I see that I've made significant advances in their Project. Both to prove that I'm working on their commissioned Project and check-in if any changes are necessary.

    • d. Once the last sketch draft is approved by the Client, no further changes may be requested. With the exception of small color changes or other minor tweaks.

    • e. The Project may take a maximum of 1 month and a minimum of 2-7 days to be completed depending on its complexity. Further delays may unexpectedly occur, unrelated to the Project, such as:

    1. Software/Hardware issues.

    2. Health issues.

    3. Order placement.

    4. Work and family issues.

    5. Any other personal issues.

    • f. If any delays occur, the Client will be notified through their initial point of contact with me.

    • g. If any delays occur unrelated to the Project and impacts the initially established deadline, the Client may request a partial refund to be negotiated.

    • h. Upon Project completion, the finished unwatermarked product will be emailed to the Client.

    IV. COSTUMER SATISFACTION

    • a. My top priority is the satisfaction of both myself and the Client with any Project I work on, I don't deliver a Project both parties aren't happy with.

    • b. To guarantee the Client receives what they requested, they must be clear in their initial request and detailed when prompted for more specifics.

    • c. The Client must also be critial and upfront about any changes wanted upon presented with Work in Progress (WIP) proof. After the last sketch draft is approved, no further changes may be requested with the exception of small color changes or other minor tweaks (exceptions may apply).

    • d. Minor tweaks include:

    1. Minor color change.

    2. Minor marking/detail addition/removal.

    3. Easy reshaping of an object/detail in the design.

    4. Any other minor change, to be decided by me if it's a minor change, won't be charged extra.

    • Any great changes will be charged upfront. Great changes involve large parts of the product having to be completely redrawn, like:

    1. Complete/Significant outfit changes.

    2. Addition/Removal/Redesign of a character.

    3. Significant background changes.

    4. Any other modifications that may require some time to complete/involve a partial/complete redraw.

    V. COPYRIGHT/USE POLICY

    • Unless discussed beforehand I, the artist, hold every right to my work, not the Client. Therefore, by owning it's rights, I'm allowed to use the copyrighted material to:

    1. Promote myself and/or my work.

    2. Print it in banners, cards, zines or any piece of media I desire.

    3. Display anywhere to my liking.

    • Owning the rights to my work does not entail:

    1. Claim the Client's design's (characters, weapons, etc) as my own.

    2. Sell the rights to Client's design(s).

    3. Claim any other Copyrighted material not originally created by me as my own.

    • If my work is to be used for commercial use, Commercial Rights must be negotiated.

    • Unless requested by the Client, finished Projects will always be displayed on my socials. If the Client wishes for the Project to not be displayed, a Non-Disclosure Agreement (NDA) can be negotiated.

    • THE CLIENT MAY UNDER PERSONAL USE:

    1. Re-upload my work if clearly credited with a link, username and/or tag.

    2. Use my work as banners and profile pictures if credit is clear and accessible.

    3. Print my work, claim the right of its design (characters, weapons, etc, if not originally designed by me) but not the artwork itself.

    4. Use my work to promote themselves if I'm fully credited with a link, username and/or tag.

    • THE FOLLOWING IS COPYRIGHT INFRINGEMENT UNDER PERSONAL USE:

    1. Reproducing/using copyrighted Projects commercially (profitting out of my work) without negociating Commercial Rights to it.

    2. Taking credit for my work and/or omitting my signature and credit.

    3. Removing any watermarks/signatures.

    4. Altering my work without my permission.

    • ONCE AGREEING ON A RATE FOR MY WORK TO BE COMMERCIALLY USED YOU MAY:

    1. Profit and use my work for any merchandise, books, covers, props or any other item you wish to use my artwork on. WITH THE EXCEPTION OF NON-FUNGIBLE TOKENS (NFT), CRYPTOCURRENCY OR ANY BLOCKCHAIN MEDIA, AS WELL AS AI LEARNING OR ANY OTHER MACHINE LEARNING PROGRAMS.

    2. Promote yourself and/or your products or brand.

    3. Credit may still be required, discussed while negotiating rates and agreements for my work to be commercially used.

    • Negotiating Commercial Rights to any Project will NEVER allow their use in NON-FUNGIBLE TOKENS (NFT), CRYPTOCURRENCY OR ANY BLOCKCHAIN MEDIA, AS WELL AS AI LEARNING OR ANY OTHER MACHINE LEARNING PROGRAMS as it damaged and directly goes against the message of my brand. If this agreement is broken, the rights to my work will be revoked from the Client.

    VI. CANCEL/REFUND POLICY

    • I have the right to cancel and refund client's orders at any time if I deem unable to deliver an order, am unable to work on it under an undefined time or for an unspecified reason that may bring me to take the previous actions.

    • You have no right to cancel or demand a refund under any circumstances after the order is completed.

    • If a payment was not made yet, the client has the right to cancel the order without any charges.

    • If the client cancels the order and it's still in progress, the amount refunded will be based on how developed the order is. The amount is decided by me.

    • If an unauthorized charge-back is filed against me, any rights to my work will be permanently retracted and I have the right to use it as I see fit. A charge-back will also guarantee:

    1. To be permanently placed on my Blacklist, where you'll never be able to commission me again.

    2. Your actions to be publicly posted online as a warning to other artists/services/businesses who offer similar services.

    3. For me to have all the rights to file a complaint, pursue legal action and have all the rights to the money you have given me for my services.

    WHAT I CAN DO

    • OC/FC's or any other type of original character/design.

    • DnD characters, DnD campaign posters, anything DnD related (Love to do that!!).

    • Design mascots or other branded cartoons for events/businesses/teams/etc.

    • Commissions based on written/image descriptions.

    • Real people (ex.: Portraits of a person, an actor, etc).

    • Anime/Manga/Comic/Movie/Series/Game+ characters from any fandom/series/etc.

    • NSFW and Erotic artwork (With some restrictions).

    • Armored characters, mecha and cyborg influences/traits, as well as animalistic/anthro characters (WARNING: depending on the type of commission, I might raise the price).

    • LGBT+ themes/subjects and LGBT+ characters.

    • Characters of all body types and shapes, gender, sex and age!

    WHAT I WON'T DO

    • NSFW and Erotic artwork that I may deem uncomfortable (Please ask first if I'm comfortable with the type of artwork you wish to commission first).

    • NSFW and Erotic artwork of real people, minor/minor looking characters.

    • Animals as the main focus of the piece.

    • Artwork for NFT or any Blockchain media, as well as materials to be fed to AI learning or any other machine learning programs.
